1. Introduction and Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Javna Limited, a company incorporated in England and Wales under company registration number 16142888, with its registered office at 46 Gainsborough Avenue, Tilbury, RM18 8LR, United Kingdom ("Javna", "we", "us", or "our"), trading as PrivateByRight VPN.
By accessing, downloading, installing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
2. Eligibility
You must be at least sixteen (16) years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
3. Account Registration and Security
To access the Service, you must create an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Description of Service
PrivateByRight VPN is a virtual private network service that encrypts your internet traffic and routes it through our servers to protect your privacy and security online. Features include AES-256-GCM encryption, WireGuard/OpenVPN/IKEv2 protocols, kill switch, DNS/IPv6/WebRTC leak protection, and servers in multiple countries.
5. Subscription Plans and Fees
The Service is offered through paid subscription plans. All subscriptions are billed on a recurring basis. By subscribing, you authorise Javna (through Stripe) to charge your selected payment method on a recurring basis until you cancel.
6. Free Trials and Promotional Offers
We may offer free trials or promotional pricing at our discretion. Unless you cancel before the end of a free trial, your subscription will automatically convert to a paid subscription.
7. Refund Policy
All new subscriptions are covered by a 30-day money-back guarantee. If you are not satisfied during this period, contact support@privatebyright.com for a full refund. After the guarantee period, subscriptions are non-refundable except where required by law.
8. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You shall not use the Service to violate any law, transmit malware, conduct DoS attacks, send spam, exploit minors, harass others, or reverse-engineer the Service.
9. No-Logs Policy
We do not collect, store, or log your browsing activity, DNS queries, traffic data, connection timestamps, originating IP address, or bandwidth usage.
10. Social Impact and Donations
A portion of each subscription fee is allocated to the PrivateByRight Impact Pool, funding organisations working in digital rights, press freedom, and human rights.
11. Intellectual Property
The Service and all related intellectual property are the exclusive property of Javna Limited. You are granted a limited, non-exclusive, revocable licence to use the Service for personal, non-commercial use.
12. Third-Party Services
Payment processing is handled by Stripe, Inc. We do not store your full credit or debit card details on our servers.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. No VPN service can guarantee absolute anonymity or security.
14. Limitation of Liability
Javna's total aggregate liability shall not exceed the fees paid by you during the 12 months preceding the claim, or £100, whichever is greater.
15. Indemnification
You agree to indemnify and hold harmless Javna from claims arising from your use of the Service or violation of these Terms.
16. Termination
You may cancel your subscription at any time through the Members Portal. We may suspend or terminate your account for breach of these Terms.
17. Dispute Resolution
Disputes shall be resolved by arbitration under the LCIA Rules in London, England. Class action waiver applies to the fullest extent permitted by law.
18. Governing Law
These Terms are governed by the laws of England and Wales.
19–21. General Provisions
These Terms constitute the entire agreement between you and Javna. If any provision is held invalid, the remaining provisions continue in full force. Javna may assign its rights without your consent. Electronic communications from Javna satisfy any legal requirement that such communications be in writing.
